Kwoyelo Bail Application Moved To Gulu
The International Crimes Division (ICD) Court Judge Jane Kiggundu has adjourned the hearing of the bail application by former LRA Commander Thomas Kwoyelo to 15th November 2018 to the court which will be sitting in Gulu.
The bail application hearing was supposed to be today in Kololo but the applicant’s lawyers, led by Dalton Oponya informed court that they are not ready to proceed as it was expected.
“We are not ready to proceed with bail application today because Boris Anyuru who was in charge of gathering suretie’s documents is admitted in one of the hospitals in Gulu.”
Oponya added that Gilbert Olanya, the Member of Parliament for Kilak County is away on Parliamentary duties.
In reply to this, the Principal senior Attorney informed court that they came ready for the hearing of this application having filed their affidavit in response in time.
“Under normal circumstances, we could have asked court to dismiss this application but due to the uniqueness and the public interest in the case we shall ask court to give them another opportunity,” Kamuli.
Counsel Komakech Henry who represents the victims in the case informed court that they were served late with this application thereby requested for more time.
Kwoyelo who has spent 9 years in incarceration in his affidavit in support of his bail application says that he has a fixed place of abode and he is willing to abide by all bail terms.
“I am informed by my advocate Mr Charles Dalton Oponya whose information I believe that the offences against me are bailable and I have a right to apply for bail under the constitution of Uganda,” Kwoyelo says.
Kwoyelo is being charged with 93 counts of rape, kidnap, murder, enslavement and torture, among others.
Among the sureties to stand for him is Gilbert Olanya, MP Kilak South, Akot Anthony, MP for Kilak North and a one Olanya Lubel.
