High Court Upholds Speke Hotel Ownership in Wakiso Land Dispute

The High Court of Uganda has dismissed businessman Peter Musoke Gukiina’s long-standing land claim against Speke Hotel (1996) Ltd, firmly confirming the hotel’s ownership of disputed plots in Kongero, Wakiso District.

Delivering the ruling, Hon. Lady Justice P. Basaza-Wasswa rejected Gukiina’s argument that his kibanja extended beyond his registered Plot 50 into adjacent plots Busiro Block 443 Plots 49, 52, 74, and 76 held by Speke Hotel.

Gukiina had accused the hotel, owned by tycoon Sudhir Ruparelia, of trespass, unlawful eviction, and destruction of his developments, including a banana plantation, structures, and business installations on the lakeside property.

The court found that Gukiina failed to establish lawful or bona fide occupancy beyond Plot 50. The judge cited the “best evidence rule”, holding that oral claims could not override clear documentary evidence. Contradictions in Gukiina’s submissions and the absence of key witnesses further weakened his case.

Speke Hotel was confirmed as a bona fide registered proprietor, having acquired the land through proper transactions without notice of competing claims.

Neither party has announced plans to appeal.
