Kampala businessman Moses Namatiti through his Namex Ministries limited has sued Deputy Speaker, Thomas Tayebwa and businessman Hamis Kiggundu for alleged land grabbing and unlawful demolition of property.
Court documents show that the two are sued jointly with Kampala District Land Board, Kampala Capital City Authority and local company, Kiham Enterprises Uganda Limited in a civil suit number 0049 of 2026.
Namex Ministries limited through its lawyers Kintu Nteza & Co. Advocates contends that in 2007, it was approached by the management committee of Nakivubo Settlement Primary School requesting it to partner with the school for construction of a convenience facility for use of their students, teachers and their families which he accepted on condition that he would be allowed to put up separate commercial stances including stores, offices and public sanitation facilities on the west end of the school land adjacent to St. Balikuddembe (Owino) Market.
The proposal was presented to KCC as the school controlling authority for approval. KCC through the senior Principal Town clerk approved the proposal and Proceeded with the design and architectural drawings of a four storied structure, Bill of Quantities and a letter of commencement that were presented to Namex for implementation.
Namex ministries Limited contends that it fully implemented the project by building the four floor structures for the mutual benefit of the school, the community and Namex as per the then KCC specifications. That Namex and its investments have been on the land from 2007 until the night of March 7, 2026 when Ham Kiggundu using rogue security operatives and goons deployed heavy duty machinery to illegally demolish the buildings before looting the merchandise therein.
Through its lawyers Namex Ministries accuses Kampala District Land Board of fraudulently processing a Land title for Deputy Speaker, Tayebwa for the land that was occupied and utilized by Namex Ministries and for at least two decades. Namex claims that the land was not available for leasing to the Deputy Speaker since it is owned and occupied by it and that the title held by Tayebwa is a nullity.
Namex ministries is also accusing Ham Kiggundu of impunity, greed and land grabbing when he deployed rogue security officers and goons who demolished his commercial buildings in the wee hours of March 7,2026, without following due process.
Namex Ministries Limited seeks several remedies in court including a declaration that it is the lawful owner of the land on plot 22A Nakivubo Road and the certificate of title held by Tayebwa be cancelled on grounds of fraud and illegality. The Company also wants court to order Businessman Ham Kiggundu to pay him Shs.5 billion in compensation for damages, impunity and criminality exhibited in the illegal demolition.
The case has been assigned to the Head of Land Division, Judge Damalie Lwanga for proper Management. Meanwhile the court has summoned the accused parties to file their defence within 15 days from the date of receiving the court documents.
“Should you fail to file a defence on or before the date mentioned, the plaintiff may proceed with the suit and judgment may be given in your absence,” read the court documents.

In a separate statement through his X (Twitter ) account, Deputy Speaker Tayebwa confirmed that he obtained a lease for a plot in the Nakivubo area in 2018.
“This was done through the formal and legal processes available to any citizen—I applied, followed the stipulated procedures, and paid all requisite fees like anyone else,” he wrote.
According to Tayebwa, he submitted building plans for approval and KCCA informed him that the land was required for their strategic activities and public purposes.
“KCCA then offered to compensate me and I accepted their proposal. KCCA went ahead and took possession of the land approximately three years ago,” he added.
The case comes after four people were charged and remanded to Luzira Prison for allegedly carrying out a demolition without a permission from the city authorities.
